Elevator Section will return to enforcement of HAR, Title 12, Chapter 229 on April 1, 2015
The HAR for elevators requires elevator contractors who are working on new, altered or repaired elevator units or kindred equipment to apply for permits for the work. If there is no permit there will be penalties assessed for non-compliance up to and including fines of $10,000 per day for each day that there is no permit issued for an active project. HAR 12-229-4.1, 12-229-12.1 (b)(1) and (c)(1).
Serious code discrepancies and violations that are found during an inspection or test which must be corrected in thirty days will incur penalties assessed for non-compliance up to and including fines of $10,000 per day for each day that the serious code violation remains unabated after the initial 30-day correction period. HAR 12-229-12.1 (b)(1) and (c)(1).
HIOSH is re-starting this policy after a hiatus because while some parties correct discrepancies in a timely manner, others do not. As a regulatory agency, HIOSH is obligated to ensure public safety by uniformly enforcing the law. This policy will begin April 1, 2015.
